Minutes of the Regular Meeting held on

Thursday 13 June 2024 at 6.30pm at Silverdale Library

139/24 Public Participation:   One member of the public was present.
140/24 To receive apologies (in writing to the Clerk)         

Apologies were received from Cllr Adcock and Cllr Murphy. The meeting noted the resignation of Clare Bennett. The Chair thanks CB for their hard work.

141/24 To resolve that the minutes of the Annual and Regular meeting held on 9 May 2024 are correct  and for the Chair to sign at the meeting.

RESOLVED to approve.

142/24 Declaration of Disclosable Pecuniary interest in any item on the agenda – None                               
143/24 To consider co-option to councillor vacancies                                                                                   

RESOLVED to co-opt Sam Toon to one of the councillor vacancies. Mr Toon was welcomed to the Parish Council and the declaration of acceptance of Office was signed.

144/24 To approve and accept the Members Code of Conduct                                                                      

RESOLVED to approve.

145/24 To approve the risk assessment                                                                                                        

RESOLVED to approve.

146/24 To note the written update from the Borough Councillors                                                                 

None of the Borough Councillors were present. The meeting noted the written reports which had been circulated.

147/24 Community matters (Standing item)                                                                                                 

a.     To receive an update on the afternoon tea events.

The event had been publicized and numbers were growing. Aspire had given JC the access code for the room. The event is taking place on 16 and 17 July from 2pm onwards.

b.     To receive an update on summer activity events for children.

It was RESOLVED to cancel the event for the time being and to reschedule.

148/24 Planning sub-committee feedback (Standing Item) and to approve comments for the following  Planning Applications 

24/00391/FUL | Retention of twostory side extension | 12 Pepper Street Silverdale NewcastleUnder Lyme Staffordshire ST5 6QJ (newcastlestaffs.gov.uk) RESOLVED to object. HA to prepare the comments.

 

24/00101/FUL | Application for residential development (14 dwellings) within Use Class C3,formation of open space, hard and soft landscaping, provision of access and associatedengineering work. | Land At Bath Road Silverdale Newcastle Under Lyme Staffordshire(newcastlestaffs.gov.uk) RESOLVED to object. HA to prepare the comments.

149/24 Finance  

a. To approve the payments, receipts and transfers – Appendix A. RESOLVED to approve.

b.     To note and approve the bank reconciliation – Appendix B. RESOLVED to approve.

c.      To note and approve the budget report – Appendix C. RESOLVED to approve.

150/24 Year-end accounts 2023/24

a.     To note the Internal Auditor Report 2023/24 and outcome of the Internal Auditor for the Accounts year ending March 2024– Appendix D RESOLVED to approve.

b.     To approve Section 1 Annual Governance Statement 2023/24 for the Accounts year ending March 2024 – Appendix D RESOLVED to approve.

c.      To approve Section 2 Accounting Statements 2023/24 for the Accounts year ending March 2024 – Appendix D RESOLVED to approve.

d.     To note the dates for the exercise of public rights.

Noted that the exercise of public rights would begin during the week commencing 24 June 2024.

HA and CM congratulated DP on the successful outcome of the internal audit.

151/24 Walley’s Quarry Ltd Landfill        a. Walley’s Quarry Liaison Meeting

There is a public enquiry on 23 July regarding the decision made by the Environment Agency which allowed the operator to continue to use the site before the abatement notice had expired. HA to write to complain to the BBC as the Quarry is not within Silverdale as reported.

152/24 Neighbourhood Development Plan 

a.     To receive feedback from the Neighbourhood Planning Steering Group.

Meetings are taking place between members of the public and Parish Councillors and Borough Councillors.

b.     To consider a quote for an ecological survey. RESOLVED to approve the quote for £1089 plus VAT.

c.      To consider a quote from Urban Vision for writing the policies for the NDP. d. To discuss funding for the NDP.

There is an opportunity to apply for a grant of up to £4000 relating to consultant’stime. RESOLVED to approve the submission of an expression of interest to apply for funding. RESOLVED to pay DP for NDP hours.

e. To discuss the restrictive covenants on Keele Golf Course. This was discussed.

153/24 For information only – Silverdale Gardens – Planning update regarding S106                                      

JA to contact the resident and the item to be removed from the agenda.

154/24 Mining Monument progress (HLF) Project and Miners Wheel    

a. Quotes for external lighting for the Miner’s Wheel. HA to obtain a quote.

155/24 Parish jobs referred to the contractor

The contractor is not able to paint the railings due to the time involved and other work commitments.

156/24 Local Plan consultation and Keele/Silverdale Growth Corridor        a. Borough Council Plan Update  A decision will be made on 23 July.
157/24 Acres Allotments (no additional legal/site remediation/Knotweed costs) 

a. To receive an update on the tenancy at will agreement.

b.     To receive an update on the appointment of Knights solicitors and negotiations over the tenancy with Acre Allotments involving the borough council and the condition of the land at the first extension of the 2015 lease

c.      To agree in principle that if the Borough Council clears the waste material on the council’s land beyond lane four then Silverdale Parish Council would negotiate a new lease for the whole site (previously known as Acres Allotments Nos 1-80)

There is no update. The meeting discussed the matter and HA is to follow up.

158/24 To consider any grant applications (SPC Grant Programme £2,000) None received.
159/24 GDPR (Standing Item) – INFORMATION ONLY

Subject Access Requests/Information Security/Data Breaches. None. RESOLVED to approve the Data Protection SLA with SCC.

160/24 To receive an update on the noticeboard project  

a. To receive an update on the refurbishment of the noticeboard. IG is refurbishing the noticeboard.

161/24 To consider purchasing benches for Silverdale Parish (Bath Road and Parksite)                                  

Item rolled over.

162/24 To receive and update on flooding reports on the Mineral Line at Sutton Avenue/High Steet             

Silverdale

JA to contact the engineer at NBC.

163/24 To note the Staffs Parish Council Assoc Bulletins and correspondence received. Noted.                     
164/24 Highways matters (Standing item)                                                                           
165/24 To discuss parking issues relating to the Athletics Club                                                                      

Complaints had been received from residents about parking at the time of an event. It had been noted that stewards had been in attendance and parking had been taking place on the industrial estate.

166/24 To consider a litter picking contract                                                                                                  

RESOLVED to find a contractor to carry out litter picking on a three-month trial to cover Silverdale Park, The Parade, the Mining Monument and Stonewall.

167/24 To discuss councillor email addresses                                                                     Email addresses for new councillors have been set up with SCC and will be set up by the councillors.
168/24 To receive an update on the maintenance agreement on the Mining Monument with obtaining a quote for the Mining Wheel from Plowden Smith

The refurbishment of the Mining monument is taking place on 9 and 10 July.

169/24 Bonfiglios Garage site Cemetery Road update. No update.
170/24 To consider changing the date of the July meeting to 4 July.                                                              

RESOLVED to change the date of the next meeting to 4 July. RESOLVED to change the meeting dates to the first Thursday of every month.

            THE NEXT MONTHLY MEETING WILL TAKE PLACE ON 4 July 2024, at 6.30pm

Report from ward Councillor Rupert Adcock

Walleys Quarry

Due to the general election, the public hearings have been delayed with a date of Tuesday 23rd July being selected; a whole day and an evening session. The committee of inquiry is due to meet again this week to look over the submissions and decide upon the running order for then day. This will then be advertised to local residents.

We were pleased to have a presentation from the UK Health Security Agency at our last meeting and had the opportunity to ask questions about the potential health impact of long term exposure to landfill gas. Until we have the corrected data they cannot issue a definitive risk assessment on this. We have continually asked the EA for this and we still await it’s release.

At Health, Wellbeing and Environment committee last week Cllrs heard a report about the reduction in off site odours since March but we remain concerned by the further permit breaches that were recorded and the odour spikes which are still happening, we also do not know whether site works or weather are responsible for the changes.

The legal case against the operator is still being prepared and Walleys Quarry have issued correspondence to council preparing their defence, claiming ‘exemplary’ site management and denying responsibility for off-site odours.

Bath Road development

I had a letter which was also circulated to residents on Bath Road about the delay to the demolition of the site due to potential bats in the roof space and the need to obtain a license from Natural England.

I attended a meeting of the councils strategic planning group about this development and we saw more

detail about the plans including the raised elevations at the front, parking to the rear, the design of the properties and the moving of the bus shelter further down Bath Road. I was supportive of the proposals as part of the redevelopment of housing in Parksite but I expressed disappointment that Aspire have now chosen to solely have residential units without a commercial space. Residents in Parksite will be disappointed with the loss of their shop. Cllr. Brown and I had been trying to persuade Aspire to let out a unit to the old tenant.

Rough sleeper

Along with many other residents, I reported the rough sleepers on The Parade a few weeks ago to the

council, to a homeless charity and to the police. There were concerns about crime and I was in contact with PCSO Neil Moffat about this.  We also reported the related fly tipping near the mineral line.

Local Plan

Cllr will be having a briefing on the local plan in July which will hopefully give some responses to the

public consultation, add more detail onto proposals and prepare the way for the next round of consultation to take place before the end of the year.

Potholes

I have reported some more potholes around Silverdale and was pleased that the ones reported on Scot Hay road and Underwood Road have now been fixed.

Walley`s Quarry. Walley`s Quarry. Due to the calling of the General election 4.7.24 the WQ Inquiry day

has been postponed until 23.7.24. Evidence has arrived form many sources including the M.P. the Labour PPC, Silverdale P.C. and other community organisations. There is an interim meeting scheduled for 13th June at NULBC.

Planning & housing: Silverdale Sidings Section 106 money   I still have not heard from Anthony Harold

Head of Legal at NULBC who I reminded about the case back in April.  As there is no Chief Exec at present due to Martin Hamilton`s departure Anthony Harold is exceptionally busy as he will be the Acting Returning officer in the General Election.

Anti-social behaviour

After the eviction of the problematic tenants on Church st, in a property owned by `Salt Box` there was an

issue where the evicted tenants set up a temporary camp on the lower parade. After lots of work from the PC Chair, PCSO Neil Moffat and the homeless hub at NULBC the situation was resolved, and they have now left the area. PCSO Moffat gave me some news on a special operation to tackle the persistent problem of off road bikes. He gave me a poster which I will post on FB to encourage residents to contact Staffordshire police if they have information ie where bikes are kept and video evidence.

On 30.5.24 I visited Heritage Park with PCSO Neil Moffat and knocked on doors in the park vicinity to

check on the situation with any Anti social behaviour. No current problems were reported.

A very unpleasant case of prolonged Anti social behaviour in the Bath rd/Cheddar drive area of Parksite

has come to my attention this week. I met with concerned residents in a neutral venue. I have made an appointment with the police for Mon 16th June to look at previous intel on this case and will be liaising with Michelle Hopper of NULBC.

General Comments:

Toddler story sessions continue every Monday 1.45-2.15 at Silverdale Library.

Yr. 4 from Silverdale Library will be visiting on Mon 1st July to have  atour of the library and then a litter

pick in the library vicinity.

Baby rhyme and song time 2.15-2.45.

It is General Election time and of course local politicians are very busy at present. Hopefully I will have

more time in the ward after 4th July.
