191/22 To resolve that the minutes of the SPC Annual and Regular meeting held on 14 July 2022 2022 are correct and for the Chair to sign at the meeting

RESOLVED to approve the minutes which were signed by the Chair. It was agreed that the SPC Standing Orders and Financial Regulations would be circulated to members.

 
192/22 Declaration of Disclosable Pecuniary interest in any item on the agenda (Note member should notify Monitoring officer within 28 days if not already. They should not act or take decisions in order to gain financial or other material benefits for themselves, their family, or their friends. They must declare and resolve any interests and relationships) ALL to complete DPI forms and return electronically – To note Dispensation granted to Chrissy Mrozicki to discuss (only) the Acres Allotments.    
193/22 Chair’s statement on the conduct of meetings

The approach of the Chair in line with the Members Code of Conduct and Standing Orders was discussed. It was agreed that the SPC Standing Orders and Financial Regulations would be circulated to members. All members were asked to read the Standing Orders. The Chair confirmed that these documents give a strong rule base for decision making during meetings including the option for the Chair to halt a meeting to allow a cooling off period. If any obstacles are encountered then the Standing Orders would be approached. Council meetings are rule governed and the rules should be properly followed. CJ raised comments and was invited to talk informally to the Chair.

 
194/22 To resolve to add Chris Spence to the bank mandate as a bank account signatory

RESOLVED to add Cllr Chris Spence to the bank mandate as a bank account signatory. CS is an experienced councillor and had previously been included on the bank mandate as a signatory.

196/22 Wildlife and County Act Rights of Way: Protective marking Scheme Route around the for Keele Municipal Golf Course – See Chair’s report.

In addition CS suggested that HA check Staffordshire archive for maps showing footpaths. A discussion followed regarding new and old footpaths and whether golfers should be approached for information relating to footpaths. HA to send a letter to Newcastle Golf Club and Whichwood Park to ask about footpaths.

 
197/22 To discuss the Bowling Pavilion and future use and possible funding – See Chair’s report.

In addition the meeting discussed:

a. 4 August break in at the Pavillion.

b.     The inclusion of the Pavillion in the Neighbourhood Development Plan as a longerterm proposal.

c.      A consultation group to refurbish the Pavillion.

d.     Teenagers had asked for five-aside football pitch and to use the Pavillion as a changing facility. This would need an organization to be involved for this to take off. The teenagers had also commented that while the Park was good for older children there was no soft play are for smaller children and perhaps the Pavillion could be used for this. There was a suggestion that cameras be installed.

e.     CJ stated that the Pavillion had not been used for nine years and needs remedial work. It could be a village contact point for the Police and to provide information. CJ suggested that local builders could be contacted to refurbish the Pavillion on a voluntary basis and that people of all ages could help with the restoration and that an area for young children and benches could be included.

f.      CS commented that the borough council had organized voluntary work for children and that this would give a vested interest in keeping it in a good state. However, there are not currently any toilet facilities. The idea of a community or sensory garden was raised.

g.     SPC do not own the Bowling Green and Pavillion. It is owned by NBC. SPC would need to explore funding routes specific to the use of the property and also to involve NBC.  Item to be included on the next agenda.

198/22 To review the Policies – H&S, Media, Social Media, Equal Opportunities, Complaints, freedom of information, data protection and employment policies and procedures and add a new policy for Major Incidents (such as Flood or Fire damage) as indicted in the Appendix.

Amendments had been made to the policies by members and would be ratified at the next meeting. HA had included a new policy for Major Incidents. Item to be included on the next agenda.

 
199/22 Neighbourhood Development Plan

a.     To receive a report from the Neighbourhood Planning Steering Group to make plans for extensive consultation of residents during 2022/23.

b.     To note the next Neighbourhood Planning Steering Group meeting on 12 August and the future start to the Housing Needs Assessment package with AECON on 30 August via Teams.

202/22 Mining Monument progress (HLF bid) Project 

a.     Energy Cost from Monument Lighting Installation This is to be followed up with NPower.

b.     27 Memories of Mine packs remain for use in consultation activities.

The packs will be handed out to residents during the consultation.

A number of service vehicles had been observed at the monument at the beginning of August. This seemed to be an extensive operation to the power cabling at the power point of the monument.

 
203/22 Homeworks update and jobs 

a. To consider the list of outstanding jobs in Silverdale in view of the meeting on 17 August with Aspire Housing.

A meeting is arranged for 17 August 2022 to discuss jobs around the parish, Chair and vicechair will attend.

 
204/22 Local Plan consultation and Keele/Silverdale Growth Corridor 

a.     Borough Council Plan Consultation Issues and Strategic Options Consultation update

Cabinet decisions regarding the consultation are expected on 6 September. The opposition had asked  to call in the plan for more consultation on 10 August but this move had failed. A further consultation can be expected therefore in September/October 2022.

b.     Save Our Green Space update

There has not been a meeting due to a family bereavement. A new date is awaited.

 
205/22 To consider a fee quote for legal costs to extend the lease to include the additional site (plot numbers 45-80) at the Acres Allotments (note additional legal/site remediation/Knotweed costs).

a.     To update on the tenancy at will agreement request to NBC and resolve to ask the Parish Clerk to sign the letter of intent and for the Chair to amend the draft agreement.

b.     To agree in principle that if the Borough Council clears the waste material on the council’s land beyond lane 4 then Silverdale Parish Council would negotiate a new lease for the whole site (previously known as Acres Allotments Nos 1-80).

c.      To consider appointing a consultant regarding the remediation of waste in the legal agreement to represent the parish’s council’s interest.

The tenancy agreement had been circulated. Agreement in principle was RESOLVED. To seek confirmation from NALC of any policy guidance in this area due to the legal complexity of a lease and tenancy operating in parallel. There was a query about whether SPC insurance would cover the extension area. Acres Allotment Association are requested to send a copy of the public liability for the extra spaces to DP.

Walleys Quarry Ltd Application to allow waste carrying vehicles to park on the internal haul road between 0600 and 0700 hrs Monday to Friday except Bank and Public Holidays. See Chair’s report. It was RESOLVED to object to the application.

Report from Borough Councillor Jacqueline Brown

Ward Report to Western Partnerships: Silverdale     Date 9th Aug 2022  Number of cases: 16 Number resolved: 9 Number ongoing: 7

Planning & housing: I am working on the issues of the Section 106 money that remains unpaid for the Silverdale Sidings development. I met with J. Upton (Interim Head of Planning) and Rachel Kileen (Senior Planning officer) on 27.7.22 verbal report only. They also provided me with a useful breakdown of the Section 106 levy as follows

£66,689 for public open spaces

£55,156 for primary school places

£26,244 towards the sustainable transport strategy

The total sum will need to be updates and index linked as they have been

outstanding since 2017.I was able to ask a number of questions.

1.     Do you make checks on developers before entering into contracts with them?

2.     Why has there been such a long delay in taking action?

The August planning committee is on the 16th of August and I, and any other

interested parties, can observe on the live stream. There will be updates every other month.

I have been successful in arranging assisted bin collections for residents of Church St following the building of a large dormer bungalow on Vale St which has blocked the rear access of several houses. This seems to be an issue elsewhere in the ward e.g., area behind the Roebuck public house. Aspire sold the land (formerly corporation owned garages) to the developer. Unfortunately, there is now a very narrow strip of land at the rear for bin collection which is in a deplorable state, and no one is taking responsibility for it. I still have not heard from Aspire on this and other issues and I am considering visiting their office at the Bramptons.

Silverdale PC has had funding approved for the Neighbourhood Plan. A housing

analysis will be an important tool for us in opposing building on former KGC. Chair also has valuable new info from census in terms of negative growth in NUL population and research information on the economic performance of NUL, all of which will be very useful to us going forward. Loggerheads PC is further on in this `journey` and I spoke to Cllr A. Sweetman who has invited myself and the Chair of the PC to his surgery at Loggerheads Fire station for any advice & support.

I have been successful in establishing the ownership of land lying to the south of Mill Street. I am visiting this week to hand over the information and advice on the trees. Ownership/responsibility for land is a constant theme. In this case power companies and adjacent residents have been unable to establish the landowners and there are implications for safety & maintenance e.g., overhead power cables and trees close to property. Therefore, the resident has had to pick up the cost of tree surgery. They are now concerned about the visible roots near their property.

Environment: We are still waiting for the new date/venue for the public meeting

re Keele Golf Course organised by S.O.G.s and the Chair of Keele P.C.  A new date & venue will be organised for all stakeholders to discuss our opposition to build plans and our vision of the land usage for leisure, health & education. I will get in touch to check the new arrangements.

Walley`s Quarry stakeholder update 29/7/22 In the week 18 July to 24 July 2022

the EA received a total of 52 odour reports from local people. This is a decrease compared to the previous week. The peak day was Monday 18 July 2022 when it received 33 reports. Despite `reporting fatigue` it is vital residents keep reporting. The site remains in compliance band F in view of scores attributed to breaches on this and other occasions. The planning application submitted by Walleys Quarry Ltd to allow vehicles on site an hour earlier in the mornings is now available for public inspection. Any comments or info from the parish councillors/residents would be welcome.

Lauren Birks ideas re bowling green and pavillion

Streets & Highways: On a site visit 3.8.22 the wildflower meadow that some

residents of the Dell are unhappy with was still there. It is now looking very brown and dry due to the lack of any rain recently. I emailed Ben Morris of Aspire on 19.7.22 but as yet have had no reply, despite chasing it up by telephone on 2 more occasions.

A resident has very recently been in touch re the lack of bike parking/racks in key

areas of Silverdale e.g., Parade and Football club. I am establishing the correct contact at NULBC and possibly Aspire in relation to the Parade. It could be that there is some funding we could bid for as it very much fits in with encouraging people not to use cars especially for short journeys. At the Western partnership meeting there was a mixed response to this request. The police thought there were adequate places to chain bikes around the Parade, bus stops and WMC. Others thought that very few people cycle there.

Waste:  I have been successful in getting some waste removed from the ally

between the library and the Co-op stall i.e., a redundant freezer. However, there is still redundant furniture, shopping trolley and debris which I reported with photographs on 9.8.22. It is now school holiday time, and I am noticing more litter around the parade area, and I would like to do another litter pick. Silverdale Methodist church do a weekly litter pick and I will be joining in and looking for other volunteers!

Anti-social behaviour:  The main issue we had reported to us was the use of mopeds/quad bikes in unauthorised areas e.g., Hayings Wood and land at the back of Mill Street. We were advised to ask residents to report all incidents You can report ASB on the council’s website under the “report it” tab, or by email to asb@newcastle-staffs.gov.uk and both councillors have put this on their social media pages. Longer term the land has to be made more secure, and metal gates and CCTV would prevent/deter this behaviour. This issue was also discussed at the Western Partnership. I asked the PCs present to let me know if the `suggestions box` at Silverdale Library was required and they would consult with PCSO Moffat and let me know. I also liaised with the PC clerk to determinereporting arrangements for anti-social behaviour. The former borough council contact had left her post and the new contact is Michelle Hopper X2597  General Comments

•       My next surgery is on Saturday 13th August 10-11am at Silverdale Library. I have continued to meet regularly with Chair of Silverdale PC in between surgeries.

•       I attended a performance called `Lookout` by St. Luke’s Primary children at Keele University on Sun 17th July. The performance was very moving and included the children`s hopes & dreams for the future of Newcastle.

•       I have continued my duties as the Early Years and SEND governor at Silverdale Primary. This has included helping with interviews for new staff.

•       I have continued to work alongside volunteers at Silverdale Library.  We will be continuing our Toddler rhyme & stories in September.

•       I have assisted Silverdale Methodist church in filling in the risk assessment & paperwork for a school holiday club at the Parade Park, former bowling green area. This exercise highlighted the fact we do not have an emergency plan for the PC, but the Chair has supplied me with a suitable format and a plan of the area.

218/22 Town Board Update Chair and schemes for Knutton Village/Cross Heath including extending the proposed WiFi service from Newcastle Town Centre to Silverdale and other areas and the formation of a new community group in Knutton. See Chair’s report

195/22 Councillor vacancy update

I was notified of 3 persons who were interested after the May elections. I recently emailed to asked one who had retired had retired but was due to take a long vacation that person will contact again later in the year. No 2 came to the June meeting and No 3 still undecided.

More names are needed so we can receive applications and process them so the vacancies can be filled.

196/22 Application for a Public Footpath from Hulme Close under W&C Act 1981 The Issue

First lodged in 2011, Staffordshire County Council Legal Dept. are now considering a proposed adjustment to the Public Footpath from Hulme Close Across the Field to the outer perimeter of former Keele Golf Course. A notification letter originally sent to Keele PC (who responded separately), but it mostly concerns Silverdale PC, and our parish clerk has advised me.

Background

Under the legislation, the period to demonstrate use of any footpath was twenty years from 1981 when the municipal golf course was in full swing.

The County Solicitor is saying the evidence produced is not sufficient under that 2011 application. The 12 people mentioned in the report with written evidence (personal details of addresses are redacted) comments about the use of the footpath(s).

However, the county solicitor is stating these proposed paths are not consistent i.e., many different paths are being put forward. One suggests a circular route round the course others offer different sections including access to the ponds for fishing including Spring Pond.

I had recent contact details, so I sent an email to the one named person in the application and asked if there was further evidence to be submitted. The reply was there had been changes to the area in some plans.  I will find out what that evidence might be and report to County Council. I need to advise Parish Council that it is unlikely to have material impact due to the passage of time, the fragmented nature of the application footpath(s) evidence and the limitations of the legislation.  The next SCC panel meet in mid-September 2022.

197/22 Bowling Pavilion

The bowling green and tennis court are not used and not maintained so we seek views on how best to make use of these facilities, given the success of the mini wheels/skatepark and existing facilities for children and youth. Break in via an upper unglazed boarded window on 4 August indicated the vulnerability of the pavilion. It will be a long process to find viable uses for the pavilion, but the park will be part of the Neighbourhood Plan so we can use the next few months to find potential businesses or community use.

199/22 Neighbourhood Development Plan Steering Group Report

Neighbourhood Plan Steering Group met on 9 July and will meet next Friday 12 August. In Brief we were looking at many ways to start the consultations and to make sure we had records and plans to use if addressing a public meeting. Among the topics covered were:

  • Produce Outline Consultation Plan for the current and next year
  • Consider the preparation of suitable materials, advertising, recruitment of participants and collection of suitable evidence.
  • Widening the membership of Steering Group to Ward Councillors and others with ‘critical friend skills’
  • Consultation Events and Options for training in consultation for Councillors
  • What help do we need to begin to consult and write a Neighbourhood Development Plan? 6 Newsletter Articles all to help start consultation

Basically, this centered around what the next steps might be given that AECOM were starting the Housing Needs Assessment. 2 main questions:

  • What info should SPC ask of Planning Department? HMOs, brownfield site numbers?
  • What should the consultation focus on?

Finding out what residents’ general opinions were of Silverdale the positive and negative factors and where change was necessary as a start point.

This could be linked to there were a series of small green spaces which should be protected (whether or not the golf course is developed in the future). This was a ‘Strategic Green Buffer’ and would cover such areas as Racecourse Woodland (several issues there in the past with tree lopping and Cllr Brown’s case work re land ownership) and the Acres. An overall policy to protect such areas from development when future planning applications were being draw up. Traffic free routes and green spaces and tree belts to create a green buffer between the centre of Silverdale and streets running outwards to encourage cycling and walking could be a major policy within the Neighbourhood Plan.

It was important to identify the needs of businesses and parish council could write to them (not necessary to have a public meeting). It was important to find out if landlords (also businesses) were selling their properties which had an impact on house prices and rented provision in the area.

We had a discussion about the Mineral Line and I advised about extending that to Keele Village as a traffic free link which was suggested for the Town Deal and not pursued 5 years ago. My suggestion was to start with two or three general broad-brush meetings across Silverdale to get basic feedback (what I like about and what I don’t like about the neighbourhood and where improvements could be produced). Then focus into the needs of several sub areas to try get reasonable numbers in all these areas would be helpful so that there is a good coverage.

205/22 To consider a fee quote. Acres and tenancy at Will

Certain issues have been put to Jackie Phillips (Asset Dept. Borough Council) and her response has been circulated. The next step will involve a change to the lease the Parish Council has with Acres Allotment Association and is outside my knowledge and my technical and legal experience.

I suggest at this stage the RESOLUTION is to re-confirm agreement in principle to the proposed tenancy and we seek confirmation from an independent source, NALC in the first instance whether we should have the whole matter checked by a specialist solicitor.

213/22 Planning Walley’s Quarry earlier access for lorries SCC application

I resolve to oppose the application

One reason to oppose the application is there will be additional noise from an earlier start and the term juggernaut should be applied and asking how the proposed parking of lorries en masse at Walley’s Quarry will ease congestion when they will be leaving in batches. An alternative is to require lorries to arrive at a pre-arranged time to stagger arrival and departure times.

218/22 Town Board

Newcastle’s Bid result at DLUHC issues for Silverdale. Next Town Board meets 9 September.

The Government Department has approved the submission. Most of the work will be outside Silverdale (i.e., exceptions are the proposed Bus Route Keele-Knutton and Wi-Fi extension from town). Knutton now has a neighbourhood group helped by the intervention of Cllr Steph Talbot.
